These Terms of Service ("Terms") govern your use of justinbermingham.com (the "Site") and the mortgage origination, communication, and informational services provided by Justin Bermingham (NMLS# 368469) through E Mortgage Capital (NMLS# 1416824) ("we," "us," "our"). By using the Site or our services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and a legal resident of the United States to use our services. By using the Site, you represent that you meet these requirements.

Information on this Site, including rate quotes, pre-qualification estimates, and the $500 Pre-Approval Guarantee, is for informational purposes only and does not constitute a commitment to lend, an offer to extend credit, or a guarantee of any specific loan terms. All loans are subject to credit approval, property appraisal, title review, underwriting, and program eligibility. Rates and terms shown are subject to change without notice. Actual loan terms depend on your credit profile, loan amount, loan-to-value ratio, occupancy, property type, and current market conditions.

5. $500 Pre-Approval Guarantee

Our $500 Pre-Approval Guarantee promises that if we cannot deliver a written pre-approval decision within the timeframe agreed at intake, we will pay you $500. The guarantee applies only when (a) you provide all requested documentation in a timely manner, (b) you authorize a credit pull, (c) the loan scenario falls within standard guidelines, and (d) the agreed-upon timeframe is documented in writing in advance. By submitting your contact information through any form on the Site or by initiating contact with us, you consent to be contacted by phone, SMS, email, or mail regarding your inquiry, even if your number is on a federal or state Do Not Call registry. Our total liability for any claim arising under these Terms shall not exceed $100, except where prohibited by law.

You agree to indemnify and hold harmless Justin Bermingham, E Mortgage Capital, and their respective officers, employees, and agents from any claims, damages, or expenses arising out of your use of the Site or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Josephine County, Oregon.
